Texting and Driving

Florida is one of only five states without a law banning texting and driving. A bill is currently making its way through the Florida House and may soon make it illegal to text and drive.

Florida Death Penalty Unconstitutional

This morning, the United States Supreme Court, in an 8 - 1 decision, has ruled that Florida's system for sentencing persons to death is unconstitutional.  The system is set up to where the same jury who found the accused guilty, will participate in the "penalty phase" of the trial.  During the penalty phase, both the State and Defense will put on testimony and offer evidence in an effort to sway a jury into deciding to rule in favor of death or life in prison.  The problem the Court found was that regardless of the jury's decision, the ultimate decision power rested in the hands of the trial Judge.

Criminal Defense

The Fourth Amendment is still alive.   In a unanimous decision (9 – 0 for those of you keeping score), the United States Supreme Court held that law enforcement may not search the cell phones of criminal suspects upon arrest without a warrant.   The justices said smart phones and other electronic devices were not in the same category as wallets, briefcases, and vehicles -- all currently subject to limited initial examination by law enforcement. The issue arose following the arrests and subsequent conviction of defendants in Massachusetts and California.   In these cases, United States v. Wurie , No. 13-212 and Riley v.
