  1.  knowingly obtain or use, or endeavor to obtain or to use, the property of their employer; and

Employee Theft Penalties

In the State of Florida, if you are convicted of employee theft, the penalties that you will face will depend heavily on the value of the amount that was alleged to have been taken. 

  • Misdemeanor: if the value is less than $750, the offense is punishable by up to 1-year in the county jail, 1-year probation, and up to $1000 in fines and costs.
  • Third-Degree Felony: if the value is between $750 and $19,999, the offense is punishable by up to 5-years in state prison, 5-years probation, and up to $5000 in fines and costs.
  • Second-Degree Felony: if the value is between $20,000 and $99,999, the offense is punishable by up to 15-years in state prison, 15-years probation, and up to $10,000 in fines and costs.
  • First-Degree Felony: if the value is between $100,000 or more, and is punishable by up to 30-years in state prison, 30-years probation, and up to $15,000 in fines and costs.

Beyond the potential of harsher sanctions which may include jail or prison time, individuals charged with Employee Theft offenses will also have to deal with additional issues that include:

  •  Difficulty in finding new employment,
  •        Inability to participate in Diversion Programs,
  •  Denial of right to seal or expunge records.
